On this page

This form is provided under Article 5 of the Turkish Distance Contracts Regulation to inform the Buyer before the distance sales contract is concluded.

1.Seller

  • Trade name: Mert Pektaş
  • Address: Bahçesaray, Konya
  • Phone: 0 507 307 61 91
  • Email: mertpeko60@gmail.com
  • Website: mertpektas.com

2.Buyer

The buyer's name, address, phone and email are those entered during checkout and are added to this form when the order is placed.

3.Main characteristics and price

The name, main characteristics, quantity, VAT-inclusive price, shipping fee and total of the goods and services are shown in the order summary at checkout and added to this form when the order is placed.

Main characteristics are described on each product page. All prices include VAT and are those valid at the time of order.

4.Payment

Card payments are processed by iyzico (İyzi Ödeme ve Elektronik Para Hizmetleri A.Ş.), a licensed payment institution; card details are not transmitted to or stored by the Seller. For bank transfer, payment is made to the account shown after ordering, with the order number as reference.

5.Delivery

Goods are delivered by cargo to the delivery address given by the Buyer, within the time stated on the product page or in the order confirmation, and in any case no later than 30 days from the order. If the Seller cannot deliver within this period, the Buyer may cancel the contract. Payment-pending orders (bank transfer) are processed once payment is received. Shipping is free when the subtotal exceeds the threshold shown at checkout.

6.Right of withdrawal

The Buyer may withdraw from the contract within 14 days without giving any reason and without paying any penalty. For goods the period starts on the day the Buyer (or a third party other than the carrier designated by the Buyer) receives the goods; for services it starts on the day the contract is concluded. The Buyer may also exercise the right between the conclusion of the contract and delivery.

To withdraw, the Buyer notifies the Seller within the period in writing or via a durable medium (email to mertpeko60@gmail.com, post to Bahçesaray, Konya, or the "My messages" section of the account). The sample withdrawal form on the Returns page may be used.

The Buyer returns the goods within 10 days of the withdrawal notice. If returned with the carrier designated by the Seller, return shipping is paid by the Seller. The Buyer is not liable for changes and deterioration due to normal use of the goods.

The Seller refunds all payments, including delivery costs, within 14 days of receiving the withdrawal notice, using the same payment method and without any cost to the Buyer. Card refunds are made via the payment institution; the time for the refund to appear on the card depends on the bank.

7.Exceptions to the right of withdrawal

Under Article 15 of the Regulation, the right of withdrawal does not apply to:

  • Goods that are perishable or may expire quickly — including live plants, seedlings and saplings
  • Goods whose protective packaging, tape, seal or package has been opened after delivery and whose return is not appropriate for health or hygiene reasons (e.g. opened food products such as saffron)
  • Goods prepared to the Buyer's wishes or personal needs (e.g. fertiliser mixes or kits prepared to the Buyer's order)
  • Goods that, after delivery, are mixed with other goods by their nature
  • Services whose performance has started with the Buyer's approval before the end of the withdrawal period (e.g. consulting visits or reports)
  • Goods or services whose price varies with financial market fluctuations outside the Seller's control

8.Defective goods and complaints

If the goods are defective, the Buyer may, under Article 11 of Law No. 6502, choose to withdraw from the contract, request a price reduction, request free repair, or request replacement with a non-defective equivalent. The Seller is responsible for defects that exist at delivery; the limitation period is two years from delivery.

Damaged packages should be checked in the presence of the courier and a damage report should be drawn up; the Buyer should notify the Seller as soon as possible with photographs.

The Buyer may submit complaints and objections to the Consumer Arbitration Committee or the Consumer Court at the Buyer's or the Seller's place of residence, within the monetary limits announced annually by the Ministry of Trade. Mediation is a prerequisite for actions before consumer courts where required by law.

9.Other

The contract is concluded in Turkish. The contract and this form are stored with the order and can be viewed from the order result page and, for members, under My account > My orders.
